RTI Act 2005

The Right to Information (RTI) Act, 2005 is a landmark legislation in India that aims to promote transparency and accountability in the functioning of the government. It empowers every citizen to seek information from any public authority and makes it mandatory for the government to provide the information within a specified time frame.

Under the RTI Act, citizens have the right to access information related to government policies, programs, and activities, including:

  1. Details of public expenditure, such as budgets, grants, and subsidies.
  2. Records of government decisions, including files, documents, and correspondence.
  3. Information related to government contracts and tenders.
  4. Details of public works and projects undertaken by the government.

The RTI Act has played a crucial role in bringing transparency and accountability in governance and has helped in combating corruption. It also serves as a powerful tool for citizens to hold public officials and government bodies accountable for their actions.

Some relevant sections of the RTI Act include:

Section 2(f) – Defines “information” as any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by the public authority under any law for the time being in force.

Section 6 – Defines the procedure to file an RTI application and the time limit within which the public authority needs to provide the requested information.

Section 8 – Specifies the exemptions to the right to information, such as information that could harm national security or affect the privacy of an individual.

Section 19 – Defines the process for filing an appeal in case the public authority has refused to provide the requested information. It also establishes the role of the Central Information Commission and State Information Commissions in resolving disputes related to the RTI Act.
